Marriage contract and change of matrimonial regime
Marriage contract, change of regime, civil union (PACS): three moments at which the patrimonial organisation of the couple is chosen or revised. The Office accompanies future and current spouses in building a coherent framework.
The matrimonial regime, backbone of the couple’s patrimony
The choice of matrimonial regime structures, for decades, the patrimonial relationships between spouses and with third parties. No regime is universally better than another: it all depends on the composition of the patrimony, professional situation, presence of children from a previous union, entrepreneurial and transmission projects.
International dimension. For couples with different nationalities or residing abroad, the European Regulation 2016/1103 and The Hague Convention of 14 March 1978 determine the applicable law. We draft the necessary professio juris in the marriage contract or by joint declaration.
Our four-step method
- Preliminary meeting. Patrimony composition, life project, vocation successorale, presence of children, international dimension.
- Presentation of options. Quantified comparison of the conceivable regimes, integration of préciput and donation between spouses.
- Draft deed. Tailored drafting, integration of bespoke clauses (préciput, full attribution, deferred claim).
- Signature. At the office, information of adult children and creditors, publication.
